Why would I ask to be excluded?

If you meet the class definition in the notice, you have to decide whether to stay in the Class or ask to be excluded before the trial, and you have to decide this by May 24, 2022.

If you exclude yourself from the class action-- which is sometimes called "opting-out"-- you will not be bound by any judgments or settlement (that may or may not be reached) between Des Moines Public Schools and the Plaintiffs. Excluding yourself might allow you to pursue individual claims against Des Moines Public Schools if you have somehow preserved you rights to an individual lawsuit. If you exclude yourself, you will not be legally bound by teh Court's judgments in this class action.
